Welcome to The Riding Academy of NJ, Inc. (“Company”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, mobile applications, text messaging services, and other online products and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is intended for users who are at least 13 years old and able to form legally binding contracts under applicable law. If you are under 13, do not use the Service; if you are between 13 and the age of majority in your jurisdiction, you may only use the Service with parental or guardian consent.

When you create an account, you agree to provide accurate, current, and complete information. You are responsible for safeguarding account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

You agree not to use the Service to: (a) violate laws or regulations; (b) infringe intellectual property rights; (c) transmit harmful, abusive, harassing, hateful, or otherwise objectionable content; (d) interfere with the security or functionality of the Service; or (e) use automated systems, scraping, or bots except as expressly permitted in writing.

Agreement to Receive Text Messages. By providing a mobile phone number to us or opting in to our communications, you expressly consent to receive automated transactional text messages (SMS and/or MMS) from or on behalf of The Riding Academy of NJ at the phone number you provide.

Message Frequency. You may receive up to four (4) messages per month, unless you opt in to additional communications or sign up for time-sensitive alerts that may increase message frequency.

Opt-Out. Reply with the single word STOP to the number sending the messages to opt out of receiving further messages. After you send the STOP message, we will send a confirmation message and you will not receive further messages, except as required by law or to confirm the opt-out.

Carrier and Message Rates. Message and data rates may apply to each message sent or received. Carriers are not liable for delayed or undelivered messages. You are responsible for notifying us of any change to your mobile number.

Participating Carriers. Our messaging service operates through participating U.S. carriers including AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile, and others.

No Mobile Information Sharing (Important Notice). We do not share, sell, rent, or otherwise disclose mobile phone numbers, text messaging opt-in data, or SMS consent information to third parties or affiliates for their marketing, advertising, or promotional purposes. Mobile information will only be used to deliver the text messaging services you have opted into, to operate and improve our Service, or as required by law.

Data Collected. Data obtained in connection with the SMS service may include your phone number, carrier name, the date/time and content of messages, and other information you provide. We may use this data solely to administer and provide the Service.

No Charges from Company. While The Riding Academy of NJ does not charge a fee for enrolling in our SMS service, standard message and data rates from your carrier may apply.

Changes to SMS Service. We reserve the right to modify, suspend, or discontinue the SMS service (or any portion) at any time, with or without notice.

Our Privacy Policy, available at https://theridingacademyofnj.org/privacy-policy, explains how we collect, use, and share information about you. By using the Service you acknowledge and agree to the Privacy Policy. We may collect information such as your name, email address, phone number, device identifiers, IP address, and usage data. We also use cookies, web beacons and similar technologies.

Access & Deletion Rights. You may access, correct, or request deletion of personal information by signing into your account or contacting us at RidingAcademy1@aol.com. Certain information may be retained as required by law or for legitimate business purposes.

Children. We do not knowingly collect personal information from children under 13 without verifiable parental consent.

All content on the Service, including text, graphics, logos, images, software, and designs, is the property of The Riding Academy of NJ or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.

The Service may contain links to third-party websites, products, or services. We do not control and are not responsible for the content, practices, or privacy policies of third parties. Your interactions with third parties are solely between you and the third party.

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. You may cancel your account at any time through your account settings or by contacting support at RidingAcademy1@aol.com.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RIDING ACADEMY OF NJ BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, OR ONE HUNDRED DOLLARS ($100) IF YOU PAID NOTHING.

You agree to indemnify and hold harmless The Riding Academy of NJ, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

These Terms are governed by the laws of the state of New Jersey, without regard to conflict of laws principles. Except where prohibited by law, you and we agree to resolve disputes through binding arbitration or a small-claims court rather than jury trials.

We may revise these Terms from time to time. We will post the updated Terms with a new “Last updated” date. Continued use of the Service after those changes constitutes your acceptance of the new Terms.
